Terms of Service
These terms set the rules for using Auto Publisher, including account authority, content responsibility, publishing confirmation, prohibited activity, and platform compliance.
1. Agreement to these Terms
These Terms of Service (“Terms”) are an agreement between you and [LEGAL_ENTITY_NAME] (“we,” “us,” or “our”) governing your use of the Auto Publisher desktop application, related support, and website at [DOMAIN_NAME] (together, the “Service”).
By installing, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service or connect a platform account.
2. Eligibility and authority
You must be legally able to enter into these Terms and meet any minimum age or other eligibility requirement imposed by TikTok, Google, YouTube, or applicable law. If you use the Service for an organization, you represent that you have authority to bind that organization, and “you” includes that organization.
3. Accounts you may manage
You may connect and manage only:
- an account that you personally own; or
- an account that the owner has expressly authorized you to manage and publish to.
You must not connect, inspect, control, or publish to another person’s account without valid permission. You are responsible for keeping your device and local user account secure and for promptly revoking access if authorization ends.
4. Your content and legal responsibility
You retain any ownership rights you have in videos, text, titles, descriptions, captions, and other content you provide (“Your Content”). You grant us only the limited permission needed to process Your Content and deliver the publishing functions you request.
You are solely responsible for Your Content and must ensure that:
- you own it or have all licenses, permissions, releases, and consents needed to use and publish it;
- it does not infringe copyright, trademark, privacy, publicity, music, performance, or other rights;
- it is accurate where accuracy is legally required and does not violate advertising, consumer protection, or disclosure rules;
- it is lawful and appropriate for the destination platform and intended audience.
The Service does not review or approve Your Content for legal compliance. Availability of a publishing function does not mean the content is lawful, licensed, or allowed by a platform.
5. Compliance with TikTok and YouTube rules
Your use of TikTok, Google, and YouTube remains subject to those platforms’ current terms, developer policies, community guidelines, technical limits, and other rules. You agree to comply with all applicable platform requirements and not use Auto Publisher to cause or assist a violation.
Platform features, permissions, review requirements, rate limits, and APIs may change or become unavailable. Auto Publisher is not TikTok, Google, or YouTube, and those companies do not control these Terms.
6. User-confirmed publishing
You actively choose the video, destination account, publishing content, and timing. A publishing or scheduling action requires your confirmation through the available product workflow. By confirming, you instruct the Service to carry out that action using the authorization you provided.
You are responsible for reviewing all details before confirmation, including the account, video, text, privacy or visibility choices where supported, and schedule. You should review the resulting status and correct or remove content through the platform when necessary.
7. Prohibited use
You must not use or attempt to use the Service to:
- publish spam, deceptive content, malware, unlawful material, or content that violates platform rules;
- inflate or manipulate followers, views, likes, shares, comments, watch time, or other engagement;
- automate likes, comments, follows, account creation, or other unauthorized social interactions;
- send bulk unsolicited direct messages or conduct harassment;
- connect an account or perform an action without the account owner’s authorization;
- collect, request, disclose, or misuse platform passwords, verification codes, OAuth tokens, cookies, client secrets, or credentials;
- bypass or evade platform safety measures, rate limits, review systems, enforcement, access controls, or risk controls;
- probe, disrupt, reverse engineer, or interfere with the Service except where a restriction is prohibited by applicable law;
- use the Service in a way that violates law, third-party rights, or these Terms.
8. Authorization and revocation
Platform connections are established through official OAuth authorization. You may disconnect an account using available Auto Publisher account controls and may revoke authorization through TikTok’s or Google’s connected-app settings. Revocation may immediately prevent scheduled or pending publishing actions from completing.
You must revoke or disconnect access when you no longer own or have permission to manage an account. For information about deleting retained records after revocation, see our data deletion process.
9. Service availability and changes
We aim to provide a useful and reliable Service, but we do not guarantee uninterrupted operation, a particular publishing time, or continued compatibility with every device or platform feature. Availability may be affected by internet connectivity, local device state, platform outages, API changes, authorization expiration, platform review, quotas, rate limits, maintenance, or events outside our reasonable control.
We may modify, suspend, or discontinue all or part of the Service to maintain security, comply with law or platform requirements, address technical issues, or improve the product. Where reasonable, we will provide notice of material changes.
10. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade.
We do not warrant that every post will be accepted, processed, displayed, remain available, or achieve any reach or engagement. Platform decisions, moderation, distribution, account restrictions, and content availability are controlled by the relevant platform.
11. Limitation of liability
To the maximum extent permitted by applicable law, [LEGAL_ENTITY_NAME] and its officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, content, or business opportunities arising from or related to the Service.
Our aggregate liability for claims arising from or related to the Service will not exceed the greater of the amount you paid for the Service during the twelve months before the event giving rise to the claim or the minimum amount that applicable law requires. Some jurisdictions do not allow certain exclusions or limits, so parts of this section may not apply to you.
12. Suspension and termination
You may stop using the Service at any time and should disconnect or revoke connected accounts. We may suspend or terminate access if we reasonably believe you have violated these Terms, created risk or legal exposure, used an account without authorization, threatened platform or Service security, or if suspension is required by law or a platform provider.
Upon termination, your right to use the Service ends. Provisions that by their nature should survive—including content responsibility, disclaimers, liability limits, and dispute-related provisions—will survive. Data handling after termination is described in the Privacy Policy.
13. Changes to these Terms
We may update these Terms to reflect changes to the Service, platform requirements, or law. The “Last updated” date above identifies the current version. If a change is material, we will provide reasonable notice where required. Continued use after updated Terms take effect constitutes acceptance to the extent permitted by law.
